The filing fees for both intent-to-use (ITU) and use-based (use in commerce) trademark applications in the United States are generally the same under the TEAS Plus and TEAS Standard options. However, applicants filing an intent-to-use application may incur an additional fee of $100 per class when submitting a statement of use to demonstrate actual use of the trademark in commerce. This fee is separate from the initial application filing fee and is applicable when the applicant is ready to convert the ITU application to a use-based application by providing evidence of use.
